Domain Registration and Hosting Services
TFXweb Limited is an authorised reseller of hosting and domain services provided by Fasthosts Internet Limited . All services relating to domain registration and hosting are therefore subject to the Terms & Conditions and Terms of Service published by Fasthosts Internet Limited. Specific Terms & Conditions relate to payments of domain and hosting services
Website Design & Development
By accepting a quotation from TFXWeb Limited and authorising commencement of work the client is deemed to have reviewed and accepted these Terms & Conditions.
Invoicing and Payment
Unless otherwise stated our standard terms of payment are an initial deposit of 25% of the quoted cost, payable prior to commencement of work, followed by interim payments as separately specified within a quotation.
Notwithstanding invoices relating to advance payment, all invoices are due for payment within 14 days of invoice date.
Design & Build
TFXWeb undertake to maintain ongoing contact with the client providing opportunities to review the work being undertaken on their behalf through the design and build process. Where a projected timescale has been advised to a client TFXWeb will strive to adhere to that projection, but if it is anticipated there will be a delay the client will be notified of any potential impact on delivery of the project and the reasons why.
We will always strive to ensure that websites are compliant with current browsers (e.g. Firefox, Internet Explorer, Chrome, Edge) and that site content is viewable by the majority of visitors. However given the frequency of browser updates and changes to technology we cannot guarantee 100% functionality with all browser software across different operating systems and therefore cannot accept responsibility for content that does not display correctly or acceptably in browser updates following publication of a website, and the client understands and accepts that we reserve the right to quote for any work involved in changing the website design or website code for it to work with updated browser software.
All site content becomes the property of the client once payment has been made in full.
Invoices for provision of design services that remain unpaid thirty (30) days after the date of invoice will be considered in default. In the event of non-payment TFXWeb may, at its discretion, remove all material from its hosting package and we will not be responsible for any loss of data or revenue incurred by the client as a result of such action. Removal of material does not relieve the Client of the obligation to pay any outstanding charges assessed to the Client's account. Clients with accounts in default agree to pay reasonable expenses, including legal fees and costs for collection by third-party agencies, incurred by us in enforcing these Terms and Conditions.
Invoices for domain registrations and hosting services are raised approximately 90 days prior to renewal dates in order to allow clients sufficient time to submit notification that they do not wish to renew. Domain registrations renew automatically approximately 30 days prior to a renewal date and therefore a cancellation request MUST be submitted by the client not less than 45 days prior to renewal, failing which the client will remain liable for the renewal cost regardless.
Invoices for domain registrations and hosting services that remain unpaid by the date of service renewal will be considered in default. In the event of non-payment TFXWeb may, at its discretion, suspend hosting services and we will not be responsible for any loss of data or revenue incurred by the client as a result of such action. Removal of material does not relieve the Client of the obligation to pay any outstanding charges assessed to the Client's account. Clients with accounts in default agree to pay reasonable expenses, including legal fees and costs for collection by third-party agencies, incurred by us in enforcing these Terms and Conditions.
TFXWeb Limited cannot be held responsible for content provided by the client and published on their web site, whether this by on a site designed and built by us or on a site maintained by a client via our hosting services, and the client agrees to indemnify TFXWeb Limited from any claims resulting from its use of our services that may damage the client or any third party.
Copyright & Permissions
TFXWeb Limited cannot be responsible for ensuring that the client has permission and rights to use any information, graphics, logos, files or other content on their web site and it is the client’s responsibility to ensure that any necessary permissions and rights to the use of any copyrighted content is obtained.
This Agreement shall be governed by English Law.
TFXWeb Limited hereby excludes itself, its Employees and/or Agents from all and any liability in respect of: lLoss or damage caused by any inaccuracy; lLoss or damage caused by omission; lLoss or damage caused by delay or error, whether the result of negligence or other cause in the production of the web site; lLoss or damage to clients' artwork/photos, supplied for the site. Immaterial whether the loss or damage results from negligence or otherwise. The entire liability of TFXWeb Limited to the Client in respect of any claim whatsoever, whether or not arising out of negligence, shall be limited to the charges paid for the services provided relative to the breach has arisen.
